Section 4, was recently added to allow for removal of the Hubbard form and replacement with the Sale of Buyer’s Property Contingency (Under Contract)

Section 5, was added to allow for any other terms that may arise for a Hubbard removal

Reason for change:
When a Hubbard clause is accepted with a sales contract on a property using the “Sale of Buyer’s Property Contingency (aka Hubbard Clause)” form and the Hubbard buyer has received a bona fide sales contract on their property, there are a list of choices in the removal of the Hubbard status from the “Sale of Buyer’s Property Contingency Removal” form. Another new alternative added to this Hubbard removal form is “Sale of Buyer’s Property Contingency (Under Contract)”. This form allows the seller’s property to be put under show or deposit, and there is a date inserted for the Hubbard buyer’s and the Hubbard buyer buyer’s contingencies to be met. This is the same form a buyer submits with his/her sales contract when they have found a house to purchase, after they have gotten a deposit on their house. This new alternative addition would allow more definitive dates to be used in going forward with the transaction.

Foundation Advisory for Buyers


Foundation Advisory for Sellers

Due to ongoing reports of cracking/crumbling issues with concrete foundations in certain residential homes and condominium complexes in Connecticut, GHAR has created a new concrete Foundation Advisory for Buyers and Sellers. The goal is to ensure awareness of this issue and to document Sellers acknowledgement of the requirement to disclose any known material defect, including past or current foundation problems. Also created was a Foundation Advisory for Buyers that include the same material defects language in the Seller advisory, so buyers are aware that sellers must disclose this information. These new advisory forms will be added to Zipform. The CT Dept. of Consumer Protection (DCP) is currently investigating this issue to identify the scope and extent of foundations that are affected, and will continue to update the DCP website with consumer information related to this issue. You can learn more about this issue at the DCP website.

22Notices to Buyer. (a) Lists of Hazardous Waste Sites. Buyer is notified that the Department of Energy and Environmental Protection is required pursuant to Section 22a-134f of the Connecticut General Statutes to furnish lists of hazardous waste facilities located within the town to the Town Clerk‘s office.  Buyer should refer to these lists and the Department of Environmental Protection for information on environmental questions concerning the Property and the lands surrounding the Property.  This paragraph constitutes Seller’s notice to Buyer of the availability of such lists, as provided in Section 20-327f of the Connecticut General Statutes.

(b) Lists of Properties where Shooting Sports Conducted. Buyer is notified that a list of local properties upon which hunting or shooting sports regularly take place may be available at the Town Clerk’s office.  This paragraph constitutes Seller’s notice to Buyer of the availability of such lists, as provided in Section 20-327g of the Connecticut General Statutes.

(c)  Information Concerning Environmental Matters. January 2012 – Residential Property Condition Disclosure Report

The Legislative Regulation Review Committee has approved a revised version of the Real Estate Property Condition Disclosure Form, which implements the provisions of Conn. Gen. Stat. § 20-327b. That statute requires the seller of residential real property to provide all prospective buyers with a written disclosure report, advising the prospective buyer of information concerning the subject property. The requirement has been in effect since 1996, and is applicable to all such transfers, unless exempted under the provisions of the statute. If the seller fails to provide the report as required by law, the seller shall credit the purchaser with the sum of $300 at closing.

The form of this report is dictated by the Commissioner of Consumer Protection, who is charged with adopting an appropriate form, in accordance with the Uniform Administrative Procedures Act (Conn. Gen. Stat. Chapter 54). The newest version of the form takes into account some legislative revisions to the statute over the last several years. Those new disclosure items include information regarding flood hazards; the results of water tests performed for volatile organic compounds; leased items on the premises; municipally designated village and historic districts; and National Register of Historic Places designations. The new form also makes a number of technical and clarifying revisions to the prior form.

The new form became effective on January 10, 2012, upon its filing with the Secretary of the State.
