NA Residential Property Condition Disclosure 10/19

Two changes were made to the form during the 2021 Legislative Session related to seller disclosure of awareness of a dam on a property and how to get more information.

Under the Section titled “General Information” a new question about dams was included as question number 8:

“8) Are you aware of the presence of a dam on the property that has been or is required to be registered with the Department of Energy and Environmental Protection? If yes, explain”

Also, a notice was added about dams at letter “H” to the end of the form in the “Important Information” Section,

“(H) Dam
Information concerning the registration and categorization of a dam on the property may be obtained from the Department of Energy and Environmental Protection.”

This additional information moves the Buyer’s and Seller’s Certifications to become letters “I” and “J”.
