This form has been updated to reflect status changes made within SmartMLS and to add an “other” field.

This form has been updated to reflect changes to the state discrimination statute and to change the term facsimile to electronic.

Two changes were made to the form during the 2021 Legislative Session related to seller disclosure of awareness of a dam on a property and how to get more information.

Under the Section titled “General Information” a new question about dams was included as question number 8:

“8) Are you aware of the presence of a dam on the property that has been or is required to be registered with the Department of Energy and Environmental Protection? If yes, explain”

Also, a notice was added about dams at letter “H” to the end of the form in the “Important Information” Section,

“(H) Dam
Information concerning the registration and categorization of a dam on the property may be obtained from the Department of Energy and Environmental Protection.”

This additional information moves the Buyer’s and Seller’s Certifications to become letters “I” and “J”.
