F-1 Exclusive Right to Sell 2/25

The following option for a seller to pay the buyer's agent directly and not as part of the listing side was added to Paragraph 9:

D-1 Open Listing 12/23

The following changes in red were made to match those previously made to the Exclusive Listing Agreements.

NOTICE: THE AMOUNT OR RATE OF REAL ESTATE BROKER COMPENSATION IS NOT FIXED BY LAW. IT IS SET BY EACH BROKER INDIVIDUALLY AND MAY BE NEGOTIABLE BETWEEN YOU AND THE BROKER.
There is no customary or industry standard real estate broker fee or compensation.

3. I/We will pay you a professional service fee of __________________ $________________ or ______% of the agreed upon sales price if during the term of this Contract you find a buyer ready, willing and able to buy the LISTED PROPERTY, either for the LISTED PRICE, or for any other price acceptable to me/us. It is acknowledged and understood that you, the Realtor, may not receive compensation for the services provided hereunder from any source with respect to this Contract in any amount which exceeds the amount or rate set forth in this paragraph 3.
I/We agree that you (check applicable box):
 may advertise that compensation is being offered to buyer brokers;
 may advertise that compensation may be offered to buyer brokers;
 may not advertise that compensation may be offered to buyer brokers.


Execution by Facsimile Electronic Methods. The parties agree that they may enter into this Contract (including any amendments and riders hereto) via fax email. This consent applies only to this transaction, and either party may withdraw such consent by fax email or in writing, but such withdrawal will not affect the validity or enforceability of this Contract (or any amendments or riders hereto) after it has been entered into. Faxing Emailing, and retention of and access to email records requires a fax machine or other appropriate fax technology computer, internet account and email software.

NC-3 FSBO Commission Agreement 7/23

To be consistent with other compensation related forms, this form was updated to replace the term “commission” with “professional service fee”, add the compensation statement, update the “other statements required by law” to be in the same format as other forms and remove any reference to faxing.

E-1 Unsatisfactory Inspection Notification 10/23

This form was changed to update the bold sections that reference paragraph 17 of the contract to include the phrase “or the Rider(s) to the Contract”. This change is for clarification purposes. These statements only reflect the right to terminate under paragraph 17 of the Contract while some Riders also have termination rights within them, and the Riders are listed in paragraph 18 of the Contract.

A-1 Real Estate Purchase Contract 10/24

The following change was made to Paragraph 6 because the listing broker may not always be the escrow agent.

Deposit and Escrow of Deposits. The deposit(s) payable under this Contract shall be made at the time(s) and in the manner specified in paragraph 4, payable to the listing Broker escrow agent indicated below.
