Lead-Based Paint Disclosure – Sales & Rentals |

The EPA recently updated the Lead-Based Paint and Lead-Based Paint Hazards Disclosure requirements for real estate purchases and rentals of properties built before 1978. Key changes include:
- Updated terminology: Buyer’s Agent is now “Purchaser’s Agent,” Landlord’s Agent is “Lessor’s Agent,” and Tenant’s Agent is “Lessee’s Agent.”
- All responses must be initialed; check marks are no longer allowed.
- Simplified language regarding whether the buyer or tenant has or has not received lead-based paint records or reports (question (c)(i) and (c)(ii)).
- A new question (g) applies when a buyer’s or tenant’s agent represents the consumer, the seller or landlord is unrepresented, and the agent is compensated by the seller or landlord.
- A new footnote clarifies that a Buyer’s or Tenant’s agent must sign the disclosure only when compensated by the seller or landlord, when using the Professional Services Fee Agreement Between Brokers form, Seller to Pay the Buyer Representative's Fee Rider, and/or the Closing Cost Credit Rider (seller concession) or seller concession text written into Section 9.
Because improper or outdated forms can result in significant fines, be sure to use the new disclosure forms and complete them accurately. |
